Entity Covered: On Point Safety LLC (“Company,” “we,” “our,” “us”) Product: Sarge AI (“Sarge”)
1. Acceptance of Policy By accessing, interacting with, or using Sarge AI in any capacity, you (“User,” “you,” “your”) expressly acknowledge and agree to this Privacy Policy. If you do not agree, you must immediately discontinue all use. Continued use constitutes binding acceptance.
2. Data Collection and Use Sarge AI is designed as an on-demand interactive platform and does not retain user inputs, outputs, or records beyond the active session. We do not monitor, track, or send notifications based on your interactions. Any data you provide is solely for the purpose of generating responses during your active session. You are solely responsible for what information you input into Sarge and for safeguarding any data you export, save, or share.
3. No Retention, No Liability On Point Safety LLC and Sarge AI do not create, store, or maintain a permanent record of your use. We are not liable for any disclosures, misuses, or consequences that result from your own use of, reliance on, or sharing of Sarge’s outputs. You assume all responsibility for any risk, loss, damage, or liability arising out of your use of Sarge AI.
4. Disclaimer of Warranties Sarge AI is provided strictly “AS IS” and “AS AVAILABLE.” No warranty, guarantee, or representation of accuracy, completeness, or reliability is made regarding outputs, predictions, or guidance provided by Sarge AI. No compliance or legal guarantees are offered. All compliance decisions remain your sole responsibility. On Point Safety LLC disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and noninfringement.
5. Limitation of Liability To the maximum extent permitted by law, On Point Safety LLC, its officers, employees, affiliates, contractors, and licensors shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of Sarge AI. This includes, but is not limited to, losses related to compliance errors, regulatory penalties, equipment failure, downtime, personal injury, or environmental impact. All risk of use rests solely with you.
6. Indemnification You agree to fully defend, indemnify, and hold harmless On Point Safety LLC and its affiliates, directors, officers, employees, and contractors from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your: (i) use or misuse of Sarge AI; (ii) reliance on any output, recommendation, or result; or (iii) violation of this Privacy Policy or applicable law.
7. Governing Law and Venue This Privacy Policy shall be governed and interpreted under the laws of the State of Pennsylvania, United States of America, without regard to its conflict of law provisions. All disputes shall be exclusively resolved in the federal or state courts located in Greene County, Pennsylvania.
8. Modifications We reserve the right to modify this Privacy Policy at any time. Updates will be posted with a revised effective date. Continued use of Sarge AI after such updates constitutes acceptance.
9. Entire Agreement This Privacy Policy, together with our Terms of Use, constitutes the entire agreement governing your use of Sarge AI and supersedes all prior understandings.
